If you’ve been on Oppo a while, chances are you’ve seen me ride a rollercoaster in regards to a house. Years ago I was desperate for the approval of my parents, so I cosigned loans I knew they would never pay. It was the greatest mistake I’ve ever made.
I’ve been living with the threat of foreclosure or bankruptcy over my head for as long as I remember. ImmoralM inority and friends/colleagues gave me advice on how to diffuse the situation with the lender (deed in lieu of foreclosure, deficiency waiver, etc) before a foreclosure wa s filed. Worst case, I would have been looking at a bankruptcy, possibly losing pretty much everything.
Well, it all did fall apart. The bank eventually seemingly had me dead to rights, was promising they would sue the daylights out of me for deficiency , and in the 11th hour I was preparing to file bankruptcy.
I let one more local lawyer take a look at it. She asked me a simple question: Was I ever served the foreclosure? I thought yes because my mom had been served on my behalf, but apparently things don’t work like that in Illinois.
What followed was finding out the lender didn’t follow procedure in trying to foreclose, and thus we filed a motion to quash . After we provided our evidence suddenly the lender was very willing to make a deal. We struck a deal. The lender gets the house and they are not to come after me for anything. If they do they’ll be in contempt of court. Judge signed the deal a few days ago.
Hot darn what a weight lifted off my shoulder. Now I can enjoy the best days of my life without a dark cloud following me. And my parents? I’ve been making 2020 the year of largely pretending they don’t exist. I may not be able to change physical distance, but I can change emotional distance.

I’m glad to hear that you got the best outcome I could imagine for the situation.
I was screwed for several years thanks to my ex-wife’s foreclosure. Thankfully my credit has fully recovered, but it was a nightmare.

Fantastic, can't ask for better than that. I know it's hard to cut family out of your life. But respect is earned, it is not given away like candy.

Really though, I’m glad you slipped out from under that soul-crushing burden. Having a hefty mortgage commitment for one’s
own home is hard enough, but to be on the hook for some deadbeats’ house you don’t even live in, hoo boy that’s rough.
